Federal Judge Orders Release of Abrego Garcia from Immigration Custody
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.
In her decision, the judge noted that the authorities lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The court proceedings involve conflicting claims. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
Conditions of Release
The judge, who was overseeing his petition to removal in a Maryland district court, ruled that he must now adhere to the conditions of his bond from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
This decision marks a significant turn in a complex immigration case featuring allegations of mistaken imprisonment and disputed criminal associations.
